We are currently in the grips of a world-wide Coronavirus (COVID-19) pandemic. California is under a shelter-in-place order. All non-essential businesses are closed and residents have been ordered to stay home as much as possible.
The crisis has impacted many industries. The legal industry has not been spared this fate. Most courts are closed across California, as are law firms, with employees diligently working from home in order to do whatever they can to lessen the impact that this virus will bring forth. Here, at Vahdat & Aboudi, APLC, our staff is working remotely and able to assist our clients in the day to day handling of their case.
The Impact of COVID-19 on M Pending Personal Injury Case
As a prospective or current client of the firm, you may be wondering what this virus means for your pending accident claim. Simply put, the unfortunate reality is that this virus is likely going to place a delay on the time it would normally take to bring your case to a resolution. As previously stated, the spread of the COVID-19 virus has led to court closures across California. Currently the courtrooms are highly restricted. Most civil matters are being summarily rescheduled. In addition, on March 23, 2020, California Chief Justice Tani G. Cantil-Sakauye issued a statewide order suspending all jury trials for 60 days. Also, the time period to begin civil trials is extended for 60 days.
Similarly personal injury claims still in the pre-litigation phases, meaning if a lawsuit has not yet been filed, are also impacted. Most insurance companies, like other non-essential businesses, are closed and their adjusters are working remotely. This means that the adjusters are not able to properly evaluate accident claims and make meaningful offers. As such, your attorney may not be able to engage in successful negotiation to settle your claim for the full value that it deserves.
Can I Still File a Personal Injury Claim During the Coronavirus Crisis?
Yes, you can file a personal injury claim despite the shelter-in-place order under the COVID-19 pandemic. If you have been injured in an accident, we recommend that you contact an attorney as soon as possible. Evidence can disappear quickly. Do not wait because of the coronavirus pandemic – any delay can harm your potential case and even cause you to lose your chance to file a claim.
Although our office is currently not scheduling in-person consultations, we are available by phone or email. We can answer your questions and help you understand your best legal options.
